Terms and Conditions
1. The competition will run on www.thelondonpaper.com website from 5 June 2009 to 31 July 2009.
2. Closing date for entries is midnight 31 July 2009.
3. Competition is open to all residents of the UK aged 18 or over, except professional photographers, employees of NI Free Newspapers Ltd (“NIFNL”), DSG Retail Limited (“Currys”), Panasonic UK Ltd and their associated, affiliated or subsidiary companies, and their families, agents, or anyone connected with this competition, including the third party promotional partners.
4. Entry limited to five photographs per person. Entries should be submitted as jpegs with a maximum file size of 2MBs each. The image(s) may be submitted to any or all of the categories, which are “Londonpeople”, “Londonlandmarks” and “Your London”.
5. Entrants should submit their entry together with their name, email address and location. The image should be the entrant’s own work, not previously published and entrants represent and warrant that they are not professional photographers and their entry does not infringe the privacy rights, copyright or any other rights of any person. Obscene or inappropriate photographs/messages will not be accepted and NIFNL reserves the right to reject any photographs/messages for any reason. Prior to submitting a photograph of any identifiable individual, entrants should obtain the consent of such person or the consent of their parent/guardian if they are under 16 and advise them of the purpose of the submission and that their photograph may be published by NIFNL (including in on thelondonpaper.co.uk) and by Currys. Entries must be submitted by uploading an image on [enter url].
6. The winner is responsible for ensuring they are able to accept the prize as set out and in accordance with these terms and conditions, in the event they are unable to do so then the NIFNL reserves the right to rejudge the prize.
7. Entry is free but entrants should be aware that they may be subject to call charges depending on their own individual arrangements for Internet access.
8. An eligible entrant must be an individual and must submit an entry in the form provided by NIFNL under this promotion including their name, address and e-mail address.
9. By entering, all eligible entrants agree to abide by each and all these terms and conditions. NIFNL reserves the right, with or without cause, to exclude entrants and withhold prizes for violating any of these terms and conditions. NIFNL reserves the right to amend these terms and conditions. Any amendments will be published on the Website
10. Entrants will retain copyright in their submitted entries, however, by entering, all entrants
a. grant NIFNL the right to edit, publish and use each entry in NIFNL publications in any and all media, for publicity and news purposes for a period of 16 months after the entry has been submitted. Thereafter, NIFNL, may publish entries for editorial purposes subject to NIFNL’s usual fees.
b. grant Currys the right to edit, publish and use each entry in any and all media to promote this and any future similar competition for a period of 16 months after the winners have been announced.
11. In each case, the photographer will be credited whenever the image is used and published by NIFNL or Currys.
12. Entrants acknowledge that their images may be used in a physical Exhibition or Exhibitions which may be located in The Music Room, Mayfair London by either or both NIFNL and Currys. Images may be presented alongside of those of entrants to other similar competitions. Only shortlisted images will be displayed and these entrants and up to two (2) members of their family or friends may be invited to attend a winners’ night. Prizes may be awarded at this event. Attendees will be responsible for all costs and expenses associated with the attending evening including travel and accommodation. Drinks and light refreshments may be provided.
13. The judges will select fifteen (15) finalists (three (3) finalists will be selected from each category). The judges reserve the right to select more than three (3) finalists from any category if any category does not provide suitable finalists. The judges will then select one (1) winner from each category. Finally, one (1) overall winner up will be selected by the judges from the three (3) individual category winners. The overall winner will be the entrant whose photograph in the opinion of the judges, demonstrates the greatest flair, technique and originality and embodies the relevant category description. The judges will berepresentatives from thelondonpaper and an independent judge.
14. Winners will be notified by 31st July 2009. All reasonable endeavours will be made to contact the winners during this time. If a winner cannot be contacted or is not available, NIFNL reserves the right to select another winner from the entries which were received before the closing date.
15. There are a total of nineteen (19) prizes. The overall winner will receive a holiday package for two people to the value of £5,000 inclusive of VAT (see details below) and a Panasonic HDC-SD200 High Definition Camcorder. The remaining two category winners will each receive a Panasonic HDC-SD200 High Definition Camcorder. The remaining twelve (12) finalists we each receive either a Panasonic FS12 digital camera or a Panasonic HDC-SD200 High Definition Camcorder. Note: awarding of either the FS12 digital camera or a Panasonic HDC-SD200 High Definition Camcorder will be at the Promoters’ sole discretion and winners are not able to elect a preference.
16. The overall winner may select a holiday of their choice for two people up to the total prize value of £5,000 (including VAT). The prize holiday must be booked by 31 December 2009 and taken before 31st December 2010. Maximum value of the holiday is £5,000 inclusive of VAT. Prize does not include any other expenses other than the actual holiday and expressly excludes all airport transfers, insurance and spending money which are the responsibility of the winner and their guest.). It is the winner’s responsibility to ensure the winner and guest(s) have valid passports for the chosen destination, and any necessary visas. The holiday will be subject to the operator’s terms and conditions at time of booking and if cancelled for any reason at any time by the winner cannot be re-booked. To the extent the holiday value exceeds the prize value of £5,000 the winner will be responsible for any excess. To the extent the full prize value is not used, the balance will lapse.
17. There is no cash or other alternative to the prize stated and the prize is not transferable and no part or parts of the prize may be substituted for other benefits, items or additions.
18. The winner may be required to submit valid identification before receiving their prize.
19. The judge's decision is final and binding on the entrants. No correspondence will be entered into.
20. Neither, NIFNL or Currys will be liable for technical, hardware, or software failures of any kind or lost or unavailable network connections which may limit or prohibit an eligible entrant's ability to participate in the competition. Other than death or personal injury arising from the acts or omissions of NIFNL, Currys, or their employees, NIFNL and Currys will not be liable for any loss or damage arising out of the winner or their guest’s enjoyment of the prize
21. By entering, any subsequent prize winners agree to allow the free use of their names, photographs and general locations for publicity and news purposes during this and future promotions by NIFNL or any associated or subsidiary company of News International Limited.
22. Uses of personal data received by NIFNL or Currys in the course of the promotion are subject to the NIFNL privacy policy found on the Website and the Currys privacy policywww.currys.co.uk/martprd/editorial/Privacy_Policy. Winners' names may be published on the Website.
23. Completion and submission of a registration slip or e-mail will be deemed acceptance of these terms and conditions.
24. NIFNL and Currys reserve the right at any time to cancel, modify or supersede the competition (including altering prizes) if, in their sole discretion, a competition is not capable for being conducted as specified. NIFNL and Currys reserve the right to substitute a prize of equal value in the event that circumstances beyond their control make this unavoidable.
